CONTRACT BETWEEN PUPPY BUYER AND TIMBER KENNELS

Two year health guarantee: Timber-bred puppies sold with a full American Kennel Club registration certificate or application are automatically sold with a two year hereditary health guarantee.

Purchasing agreement: a $200 non-refundable deposit may be placed with Timber Kennels in order to hold a puppy request. If the puppy is not paid for and picked up/shipped to within a reasonable time (by 3 months of age), Timber Kennels has the right to keep, sell or give away requested puppy.

Following full payment of puppy/dog, the owner will receive a signed AKC registration or signed application for one. If sold on a limited AKC registration, the buyer will receive a signed limited registration paper or signed limited application form. If puppy/dog is sold without any registration papers or application form, the buyer will recieve a signed bill of sale. If none of these are provided to client at the negotiation time, then there is no sale and puppy/dog remains the property of Timber Kennels. If dog is placed with a client for a period of time, client does not have ownership of puppy/dog at any time.

 

Timber Kennels guarantees that to the best of knowledge, this puppy/dog is in good health. Timber Kennels guarantees that this puppy/dog can be returned at buyers expense within FIVE days of purchase for any health problems (parasites not included) and the purchase price will be refunded. At NO other time will purchase fee be refunded. The buyer guarantees to take this puppy/dog to the veterinarian during this five day period for a health examination and to advise Timber Kennels of any problems.

 

If a puppy is diagnosed after a five day period with a life threatening congenital hereditary defect, the puppy can be returned at buyers expense to Timber Kennels and replaced with another puppy of equal value shipped at buyers expense. If a puppy is not available at the time, the buyer will be in line for a puppy of equal value. A written and signed statement in detail of the defect from the veterinarian, who diagnosed the problem, must precede the return of the puppy. If a puppy dies, a full autopsy/necropsy at the buyer's expense must be performed to diagnose the problem. Full results must be sent to Timber Kennels. At no time will Timber Kennels replace a puppy that has been living in the new home for more than 2 months. This provides plenty of time for any congenital hereditary defects to appear.

 

At this time, Timber Kennels does not provide a full guarantee on HD or problems relating to Hip Dysplasia. We breed ethically to provide for the least possible occurance of HD but there are so many factors regarding the inheritance of HD that we cannot replace pup in full. If the buyer requests a replacement, we will work with you in any way we can and can offer a pup of equal value at a reduced rate of 1/4 off regular purchase price following full documentation of problem by certified veterinarian as well as OFA documentation that must be sent to Timber Kennels prior to sale of next puppy.

Timber Kennels does provide a full guarantee on PRA, Progressive Retinal Atrophy. The dog must be examined by a certified ophthalmologist and have been refused a certificate from the Canine Eye Registry Foundation due to PRA. All records written and signed by a certified veterinarian and CERF documentation must be delivered to Timber Kennels and a puppy of equal value will be offered on next available status following the return of original dog at buyers expense. If buyer wishes to keep the first pup then a pup of equal value will be offered a t a reduced rate of 1/4 off regualr price.

If a puppy is purchased with full registration for breeding and is diagnosed with a hereditary problem that is not life threatening, such as Hip Dysplasia, HD, or Preretinal Atrophy, PRA, and the buyer decides to keep the puppy, he may do so and will be offered a puppy of equal value at one-fourth off the regular purchase price. The defect must be diagnosed and documented by the diagnosing veterinarian, OFA, and CERF and all official results delivered to Timber Kennels. The original pup/dog must be spayed/neutered with a written and signed report from the operating veterinarian sent to Timber Kennels prior to sale of second pup.

Timber Kennels has had only a few puppies with defects but in the breeding of dogs it does occur from time to time. If you do buy a puppy and a problem occurs, we will work with you the best we can. Puppy/dog purchase fees are non-refundable.

In connection with all the foregoing, under no circumstances will Timber Kennels be responsible for any expenses incurred by the buyer. The foregoing warranties are in lieu of all other warranties, expressed or implied. Terms of contract apply to all Timber bred puppies/dogs sold from Timber Kennels whether implied, expressed or signed.

Lisa reserves the right to refuse sale of any Timber ACD to anyone she deems unqualified as determined by Lisa herself. This also applies to the return of any Timber ACD to any person that she disqualifies based on her personal opinion. This decision is based on the well being of the Timber ACD. None will be placed or RETURNED to neglected or abused homes and if found to be so, Lisa will retain FULL owneship of neglectd/abused dog. No exceptions!

Buyer's Responsibility: The buyer agrees to provide this puppy with the best health care and to provide for in a humane way and to protect this puppy throughout his entire life. If for any reason in the life of this puppy a need comes that the buyer must find another home for him, Timber Kennels must be notified and given the first option to take the puppy back. The buyer guarantees that at no time will the puppy/dog be turned over to the pound, humane society, or rescue. I do not for any reason want to hear of one of my puppies ending up in this situation. Any puppy/dog bought from here is always welcome back here. No matter the age or situation.

Pet Quality Puppies Sold On A Limited Registration: Puppies bought from Timber Kennels as pet quality are NOT to be used for breeding. Puppy should be spayed/neutered by one year of age. Please notify me when the puppy has been spayed/neutered. I will be expecting this procedure to be performed and vet documentation be sent to Timber Kennels. Hereditary defect guarantee does not apply to limited registration puppies.

Activity Of Your ACD Puppy: ACD puppies are extremely active and are known for injuring their legs, muscles, and joints. Please do not let your puppy do any high jumping for frisbees or agility until they are one year of age. I cannot be held responsible for injuries. Any expenses incurred by buyer are NOT the responsibilty of Timber Kennels and will not be paid by Timber Kennels. No guarantee applies to puppies/dogs injuries.

Working Guarantee: Puppies bought from Timber Kennels with the intention to be used for herding dogs are sold with a guarantee to work livestock. For this guarantee to be valid the puppy must be raised in an environment that includes stock animals (horses, cows, sheep, ducks, etc.). If by the time this puppy is one year of age and shows no desire to work livestock, then he can be returned (at buyer's expense) and replaced with another puppy of equal value. If a puppy is not available at the time, the buyer will be in line for a puppy of equal value. Puppy must have been exposed to professional trainers, clinics, and/or seminars. Documentatiion of herding behaviors must be sent to Timber Kennels including those from professional herding trainers, clinics, and seminars prior to replacement. Videos are desired as well.
